Barndex Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Barndex.com and associated services (the “Platform”). By accessing or using Barndex, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

By using the Platform, you confirm that you are at least 18 years old and capable of forming a binding contract. If you are accessing Barndex on behalf of an organization, you represent and warrant that you have the authority to bind that organization.

2. Platform Purpose and Use

Barndex is a marketing and lead generation platform designed to connect buyers, sellers, and builders of barndominiums. We are not a licensed real estate broker or agent, and do not represent buyers or sellers in real estate transactions. All listings are posted by third parties who are solely responsible for the accuracy of their information.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

  • Submit false or misleading listing information

  • Post content that is discriminatory, illegal, or violates another party’s rights

  • Use the Platform in a way that may impair its function or access for others

3. Listing Submissions

By submitting a listing, builder profile, or related materials, you grant Barndex a non-exclusive, royalty-free, worldwide license to display, modify (for formatting), and distribute your content on our website, social media, and marketing channels. You represent and warrant that you have all necessary rights and permissions to submit such content.

4. Intellectual Property

All content created by Barndex, including branding, logos, copy, and visual assets, remains the sole property of Barndex. You may not use, copy, or distribute our content without prior written permission. User-submitted content remains the intellectual property of the submitter, subject to the license above.

5. Disclaimer of Warranties

Barndex provides the Platform “as is” without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of listings or builder information. You assume full responsibility for any decisions made based on information found on Barndex.

6. Limitation of Liability

To the fullest extent permitted by California law, Barndex shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Platform, even if advised of the possibility of such damages.

7. Privacy and Data

Your use of the Platform is also governed by our Privacy Policy. We do not sell personal data. Data collected is used to improve services and facilitate listing visibility.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of San Bernardino County, CA, unless preempted by binding arbitration.

9. Modifications

We reserve the right to modify or update these Terms at any time. Updates will be posted on this page with a revised effective date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
